What is the primary function of a Mark?

A mark can be anything (e.g., word, symbol, name, logo, or product feature) used in commerce with a product or service that indicates the source of the product, service, group, or certification, and thereby distinguishes one source from another.  For example:

  • Logos, e.g., the McDonalds golden arches, the Nike swoosh
  • Alphanumeric combinations, e.g., GATORAID, ABC, V-8
  • Slogans, e.g., INTEL INSIDE
  • Colors, e.g., pink (for insulation)
  • Musical notes, e.g., NBC's chimes, the Law & Order theme music
  • Product configurations, e.g., the hour-glass shaped Coke bottle

Trademark law protects distinctive source identifiers used on goods or services.
